Summary Terms and Conditions:

1. UK, 18+ only. Presale Period 1: 12:00 BST on 25.08.2021. Presale Period 2: 12:00 BST on 01.09.2021. Internet connection, email address and Twitter account required. First 4,000 individuals on 25.08.2021 and, first 1,000 individuals on 01.09.2021 presale to tweet @CadburyUK and #WISPAGOLDHF will be eligible to purchase one fictional ‘share’ for 69p (this is not an actual share in a Mondelez Group company). Any fictional ‘shares’ which have not been issued by 16:30 on 25.08.2021 may be rolled over to 01.09.2021 at the absolute discretion of Mondelez. Successful entrants must redeem their fictional ‘share’ before 23:59 on date of issue by following link provided by @CadburyUK. At the time of purchase, the fictional ‘share’ shall equal one unit of Wispa Gold Hazelnut Flavour. Only one fictional ‘share’ may be purchased per individual. A minimum of 1 bar up to a maximum 6 bars of Wispa Gold Hazelnut Flavour may be returned from one fictional ‘share’ on closing of the campaign. Wispa Gold Hazelnut Flavour will be available in shops nationwide from 06 September 2021. At no point during their purchase or at any point during the promotion are actual shares in any of the Mondelez group of companies or its affiliates transferred to a consumer nor will any sales figures will be made available. Full Terms and Conditions:

2. This Presale is only open to residents of the United Kingdom who are aged 18 or over. Entrants must have a valid email address.

3. 2 (two) Presale Periods: 12:00 BST on 25.08.2021 & 12:00 BST on 01.09.2021. The presale will run from 12:00 BST until all codes have been claimed or from 12:00 BST until 16:30 BST on the day of the presale event. Redemption of the code must take place before 23:59 on the date on which a successful entrant is given a redemption code. If not used within the allotted time frame, the code may not be redeemed.

4. Moderation: @CadburyUK reserves the right to reject entries which, in its reasonable opinion:

    a.  contain any material which: (i) is offensive and/or derogatory, (ii) is of an explicit and/or sexual nature, or (iii) is defamatory, libellous, obscene or disparages the Promoter in any way, or (iv) is otherwise illegal;

    b.  contain any material which violates any third party intellectual property rights (including, but not limited to, copyright, trade marks, or any other proprietary or personal right);

    c.  contain any trade/brand logos or references other than incidental inclusion and/or relating to the Promoter’s products; and

    d.  Promotes any political or religious agenda.

5. First 4,000 individuals on 25.08.2021 presale to tweet @CadburyUK and #WISPAGOLDHF will be eligible to purchase a fictional ‘share’ for 69p. At the time of purchase, a ‘share’ shall be equal one Wispa Gold Hazelnut Flavour bar. Subject to availability, fictional ‘shares’ may be available until 16:30 on 25.08.2021. If any fictional ‘shares’ remain available after 16:30 on 25.08.21, outstanding fictional ‘shares’ may be rolled over to 01.09.2021 at the absolute discretion of Mondelez. Successful entrants must redeem their fictional ‘share’ before 23:59 on date of issue by following link provided by @CadburyUK (see clause 8 for details).

6. First 1,000 individuals (or such other number that may be available if fictional ‘shares’ are rolled over from 25.08.2021) on 01.09.2021 presale to tweet @CadburyUK and #WISPAGOLDHF will be eligible to purchase a fictional ‘share’ for 69p. At the time of purchase, a ‘share’ shall be equal one Wispa Gold Hazelnut Flavour. Subject to availability, fictional ‘shares’ may be available until 16:30 on 01.09.2021. Successful entrants must redeem their fictional ‘share’ before 23:59 on date of issue by following link provided by @CadburyUK (see clause 10 for details).

7. How to Enter on 25.08.2021: Individuals can only enter the presale via Twitter. To join, on 25.08.2021 the individual must post a tweet including @CadburyUK and #WISPAGOLDHF and be one of the first 4,000 individuals to do so between 12:00 BST and 16:30 BST. The first 4,000 individuals (or Twitter handles) to tweet these will then be eligible to purchase one fictional ‘share’ and sent a congratulations message informing them of them that they and entitled to enter the presale. Those who tweet after the first 4,000 tweets will be sent a commiseration message informing them of the second presale on 01.09.2021. Both the congratulations and commiseration message will be visible only to the individual who tweeted. Users may enter as many times as they wish but each twitter handle is only eligible to successfully join the presale once.

8. Product Purchase 25.08.2021: those individuals who have successfully entered the presale via the @CadburyUK Twitter account will be sent a dark tweet with a link to Wispa Gold Hazelnut Flavour landing page where they can register for a redemption code. Mondelez takes no responsibility for individuals sharing their redemption code with third parties. Once a successful entrant visits the landing page, they will need to register and accept T&Cs before being directed to the Cadbury Gifts Direct website to buy their fictional ‘share’ via the Wispa Gold Hazelnut Flavour product page. Once there, the individual can put the fictional ‘share’ (equal to one Wispa Gold Hazelnut Flavour) in their basket, proceed to checkout, input their unique redemption code and pay 69p for the fictional ‘share'. Postage for bars returned on closing of the campaign is included. The unique code can only be used in the discount box once. If not redeemed once input into the discount box, the code becomes invalid. If an individual’s code is invalidated they should contact Cadbury via Cadbury’s social media channels.

9. How to Enter on 01.09.2021: Individuals can only enter the presale via Twitter. To join, on 01.09.2021 the individual must post a tweet including @CadburyUK and #WISPAGOLDHF and be one of the first 1,000 (or such other number at Mondelez absolute discretion) to do so between 12:00 and 16:30 BST. The first 1,000 (or such other number at Mondelez absolute discretion) individuals (or Twitter handles) to tweet these will then be eligible to purchase one fictional ‘share’ and sent a congratulations message informing them that they are entitled to enter the presale. Those who tweet after the first 1,000 (or such other number at Mondelez absolute discretion) tweets will be sent a commiseration message informing them of Wispa Gold Hazelnut Flavour’s launch in shops from 06 September 2021. Both the congratulations and commiseration message will be visible only to the individual who tweeted. Users may enter as many times as they wish but each twitter handle is only eligible to successfully join the presale once.

11. This campaign is for a fixed period between 12:00 on 25.08.2021 and 20:00 on 03.09.2021. Once an individual has purchased their fictional ‘share’ they may not redeem their fictional share until 20:00 on 03.09.2021. The final value of one fictional ‘share’ shall be announced on closing of the campaign at 20:00 on 03.09.2021 and individuals who have purchased ‘shares’ shall be sent a number of Wispa Gold Hazelnut Flavour bars thereafter. For the avoidance of doubt, individuals may only procure a redemption code enabling them to purchase a ‘fictional share’ on 25.08.2021 between 12:00 and 16:30. A successful entrant must redeem their share on the Cadbury Gifts Direct website before 23:59 on the same day that they receive their code.

12. Fictional ‘shares’ cannot at any point during or after the campaign be exchanged for cash.

13. The value of one fictional ‘share’ may fluctuate during the campaign and the fictional value shall be represented in number by Wispa Gold Hazelnut Flavour bars. At no point during or on closing of the campaign shall the value of one fictional ‘share’ exceed 6 (six) Wispa Gold Hazelnut Flavour bars. The value of one fictional ‘share’ shall always equal a minimum of 1 (one) Wispa Gold Hazelnut Flavour bars. A minimum of 1 (one) bar up to a maximum of 6 (six) Wispa Gold Hazelnut Flavour bars may be returned from 1 (one) ‘share’ on closing of the campaign.

14. At no point during their purchase or at any point during the promotion are actual shares in any of the Mondelez group of companies transferred to a consumer nor will any sales figures will be made available.

15. You will be charged the price of 69p for one fictional ‘share’ at the time of placing the Pre-Order. Methods of payment accepted are: (1) Debit Card Payment (2) Credit Card Payment.

16. The price of one fictional ‘share’ shall include postage of Wispa Gold Hazelnut Flavour bars on closing of the campaign. Nothing else from the Cadbury Gifts Direct site shall include postage. Postage will be by standard Royal Mail post. Delivery is subject to Cadbury Gifts Direct terms and conditions.

17. When placing a pre-order, you will be required to provide certain information, such as your address and other billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. MDLZ shall have no responsibility or liability for inaccurate information or information that later becomes outdated and shall have no obligation to make efforts to determine the correct contact or shipping information.

18. Individuals posting tweets post tagging @CadburyUK and/or including the hashtag #WISPAGOLDHF may have their tweet featured in livestreams during the campaign. You warrant that you have freely consented to your twitter handle and/or twitter profile picture, which may include your image (the “Campaign Information”) being used in connection with the campaign in the UK.

19. You grant to MDLZ and its affiliates the right to use, reproduce, republish, share, translate, modify, adapt, distribute and exploit your Campaign Information including your name, image, words and twitter handle and profile photo throughout the universe in perpetuity for any purpose in any and all media now known or hereafter invented and by any means. Notwithstanding the above, this includes but is not limited to distributing your tweet via social media channels, websites, or other publically available platforms.

20. You acknowledge and understand that you will not receive any remuneration for your contribution in the campaign which will feature in the UK. You may not now or in the future make any claims against MDLZ for use of the Campaign Information.

21. MDLZ has full discretion over the Presale, and any decision of MDLZ in all matters is final and binding and no correspondence will be entered into.

22. No responsibility can be taken for tweets which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. MDLZ does not guarantee continuous or secure access to Twitter.

23. This Pre-sale is in no way sponsored, endorsed or administered by or associated with Twitter. You are providing information to MDLZ and not to Twitter.

24. MDLZ together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Presale except for any liability which cannot be excluded by law. Nothing will exclude MDLZ’s liability for death or personal injury as a result of its negligence.

25. An entry must be made directly by the individual entering the Presale. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that an individual is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that individual’s chances in the Presale in a way that is not consistent with the rules of the Presale, that individual’s entries will be disqualified and any entry will be void.

26. Should an act, omission, event or circumstance occur which is beyond the reasonable control of MDLZ and which prevents MDLZ from complying with these Terms & Conditions MDLZ will not be liable for any failure to perform or delay in performing its obligations.

27. MDLZ and Cadbury Gifts Direct shall comply with all applicable requirements of the Data Protection Act 2018, the General Data Protection Regulation 2016 and any successor legislation or other applicable law. The personal information individuals provide will be used by the Promoter for the purpose of conducting this Presale and in accordance with the MDLZ’ Data Privacy Notice which can be found at www.cadbury.co.uk/privacy. MDLZ may disclose individuals’ personal information to its contractors and agents to assist in conducting this Presale (including any relevant activity) or communicating with individuals.

28. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.

29. By entering this Presale, you will be deemed to have agreed to be bound by these Terms & Conditions.

30. In the event of a discrepancy between these Terms & Conditions and the details in any presale material, the details in the Terms & Conditions will prevail.

31. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
